Nexeus Games General Terms of Use

Effective from September 26, 2026. This is a translation of the Portuguese original; if the two differ, the Portuguese version prevails.

These terms are the basic rules for using the Nexeus Games website and all the games we publish under that brand. In them, "we" means the company named in the box above and "you" means whoever visits the website or plays. Each game also has its own terms, which detail what is specific to it. In the legal center you will find all the documents and an explanation of how they fit together.

1. What these terms cover

These terms apply to the Nexeus Games website and to all the games we publish, on Android, iOS or any other platform. The agreement between you and us is made up of:

1. these General Terms of Use;
2. the terms of use of each game, published on that game's tab on this website;
3. the General Privacy Policy and each game's privacy policy;
4. the terms of the store you downloaded the game from, such as the Google Play Terms of Service and Apple's End User License Agreement (EULA).

If a game's terms address a matter specifically, they apply to that game in place of these. None of these documents takes away the rights the law guarantees you, in particular under the Código de Defesa do Consumidor (Brazilian Consumer Protection Code, Law 8,078/1990) and the Lei Geral de Proteção de Dados (Brazilian General Data Protection Law, Law 13,709/2018).

2. Acceptance

By using the website, or installing or playing one of our games, you agree to these terms. If you do not agree, do not use the website or the games. You may stop using them at any time: just uninstall the game.

3. Age and parents or guardians

Each game states the age group it is intended for, in the store and in its terms. Anyone under 18 must use the games with the permission of a parent or guardian, who is also responsible for purchases made on the device. Google Play and the App Store offer controls to require a password or approval before each purchase, and we recommend that families with children use them.

4. License to use

We grant you a personal, free, non-exclusive, non-transferable and revocable license to use the website and to install and play our games on devices you own or control, solely for personal enjoyment and for non-commercial purposes. The games are licensed, not sold: you receive the right to use them, not ownership of the software.

Except where the law allows it, you may not copy, modify, decompile, reverse engineer, distribute, rent or sell the games, or circumvent their technical protections.

5. Accounts, identity and progress

• The games published so far do not ask for registration, email or password. When an online feature needs to identify you, such as a ranking, the game automatically creates an anonymous identity for that purpose only.
• Each game states, in its terms and privacy policy, where your progress is stored. When it is stored only on the device, clearing the app's data, uninstalling the game or switching devices erases your progress.
• You are responsible for keeping your device and your store account secure.

6. Coins and virtual items

Coins, lives, boosters, characters, collectibles and any other in-game items (the "virtual items") are a limited license to use within the game. They:

• are not your property and have no cash value;
• cannot be exchanged for money or goods, or sold or transferred to another person or account;
• may have their coin prices, rewards and rules adjusted to keep the game fair and fun, without taking away from you what has already been delivered.

We may correct items delivered by an evident technical error, such as the same purchase delivered twice, or obtained by cheating.

7. Purchases and refunds

• In-game purchases are made through Google Play, the App Store or the platform's store. The price is the one the store shows at the time of purchase, in your country's currency, and payment is processed by the store. We do not receive your card number or any other payment data.
• Refund requests follow the store's rules: on Google Play, through the orders page of your Google account; on the App Store, through Apple's report a problem website.
• The rights provided for in the Código de Defesa do Consumidor, including the right of withdrawal where applicable, and in the law of your country remain in force.
• If you paid and did not receive the item, write to the contact shown at the top with the store's receipt. The same purchase is never delivered twice.

8. Ads

Free games may show third-party ads, delivered by partner ad networks listed in each game's privacy policy. Rewarded videos are always optional. We do not control the content of each ad or the products advertised; if you see an inappropriate ad, let us know through the contact. Personalized ads depend on your choice on the game's consent screen, which can be changed in the game's settings.

9. Conduct and fair play

You may not:

• cheat, use automation programs, modify the app or the game's memory, or change the device's clock to gain an advantage;
• exploit bugs in the game instead of reporting them to us;
• attack, overload or attempt unauthorized access to the website, the games or the services they use;
• use the website or the games for illegal or commercial purposes or to harm other players.

If we identify any of this conduct, we may, proportionately, remove or reset scores, remove improperly obtained items and block access to the game's online features. Whenever possible, we will tell you the reason.

10. Third-party services and links

The website and the games use third-party services, such as app stores, ad networks and online services, and may contain links to third-party websites. These services follow the terms and policies of whoever provides them. We are not responsible for the content of third-party websites.

11. Intellectual property

The website, the games, the Nexeus Games brand, the game names, the art, the characters, the texts, the music and the code belong to us or to those who licensed them to us. Third-party components, such as game engines, fonts and licensed music, follow their own licenses. Nothing in these terms transfers these rights to you beyond the license in section 4. If you send us suggestions, we may use them to improve the games, with no obligation to pay.

12. Availability, updates and discontinuation

The website and the games are provided as they are, with the features they have at the time. Online features depend on a connection and on third-party services, which may go offline. We may release updates, change or remove features and, with reasonable notice published on this website and, when possible, within the game, discontinue a game's online services or remove it from the stores. Some updates may be required to keep playing.

13. Liability

To the extent permitted by law, we are not liable for indirect damages, for loss of progress caused by clearing data, uninstalling or switching devices, or for failures of third-party services, such as stores, ad networks, internet providers and the device itself. Nothing in this section limits our liability where the law does not allow such a limitation, in particular regarding consumer rights and damages caused by willful misconduct or gross negligence.

14. Privacy

How we process personal data is described in the General Privacy Policy, which covers this website and the principles common to all games, and in each game's privacy policy, which describes exactly the data of that app.

15. Changes to these terms

We may update these terms when the website, the games or the law change. The new version is published on this page with the new effective date. Changes that reduce your rights apply only going forward and are published with reasonable advance notice. If you do not agree with the new version, you may stop using the website and the games.

16. Languages

The original text of these terms is in Portuguese. The versions in other languages are translations provided for ease of reading; if they differ, the Portuguese version prevails.

17. Governing law and jurisdiction

These terms are governed by Brazilian law. If you are a consumer in Brazil, you may bring legal action in the courts of your place of residence, as guaranteed by the Código de Defesa do Consumidor. If you live in another country, you keep the mandatory consumer protections of that country's law.
